In a statement issued Tuesday, CAIR said the decision ensures continued processing of applications filed by Afghan refugees, many of whom have waited years for outcomes. The group noted that earlier attempts by the US government to halt such cases, citing pauses on applications from so-called “high-risk” countries, had left thousands in prolonged uncertainty.
Faiza Duale, CAIR’s deputy legal director, said the government cannot bypass immigration laws and must ensure that asylum seekers are treated fairly under established procedures. She emphasized that Afghan applicants deserve the same legal protections and due process as others seeking refuge.
The legal dispute stems from broader policy measures introduced in recent years that slowed or suspended asylum processing for applicants from certain regions, citing security and administrative concerns. These measures drew criticism from advocacy groups, who argued they disproportionately affected vulnerable populations, including Afghans.
Following the Taliban’s return to power in 2021, tens of thousands of Afghans sought protection abroad, particularly in the United States, after working with international forces, civil society groups, or media organizations. Many remain in legal limbo, awaiting decisions on asylum or special immigration programs.
CAIR, one of the largest Muslim civil rights organizations in the United States, has been actively involved in challenging policies it views as discriminatory or inconsistent with constitutional protections. The group says the latest ruling reinforces the principle that immigration systems must operate within the bounds of the law.
Advocates say the court’s decision could help reduce backlogs and accelerate long-delayed cases, offering renewed hope to Afghan refugees facing uncertain futures. However, they caution that broader systemic reforms are still needed to ensure timely and consistent processing.
