Affidavit reveals more details in deadly east Travis County shooting
TRAVIS COUNTY, Texas (KXAN) -- A murder affidavit revealed more details after a man was accused of shooting and killing his father last week.
Around 9:36 p.m. Sunday, the Travis County Sheriff's Office responded to 9301 Hog Eye Road for a report of a disturbance, which then escalated to "multiple shots" being fired, according to court records.
When deputies arrived on the scene, they found Duan Davis, 61, with "multiple gunshot wounds lying on the ground near the bus stop in Community First Village," court records said. He was pronounced dead at the scene, according to officials.
The affidavit said two people were seen driving away in a black SUV.
TCSO identified the suspect as Davis' son, Quentyn Ervin-Davis, 19. He was arrested and charged with murder.
What led to the shooting
The events began to unfold around 9 p.m. after Quentyn and another person went to pick up Duan from Community First! Village to give him a "ride to get food," court records said.
According to the affidavit, the black SUV Quentyn was driving was not his and belonged to Duan, and Duan did not want him driving it anymore. So, Duan told his son to leave the SUV, described as a GMC Yukon, as his residence.
Quentyn was on the phone with his mother shortly after, saying he left the vehicle, and he and the person in the car were walking home, court records said.
Quentyn's mother told investigators when she was talking on the phone, she "overheard what sounded like someone running" and then someone saying something like "Don't come at us with that broom, Duan." Then, she heard what sounded like "a verbal and physical disturbance." That is when she heard two gunshots before the phone line disconnected, according to court documents.
When Quentyn was interviewed by investigators, he said Duan "was holding a broom while yelling at him to give him his keys." The person with Quentyn tried to take the broom from Duan. That is when Quentyn told Duan he had a gun and then pulled it out and shot Duan, according to the affidavit.
Both Quentyn and the other person ran away after the shooting. However, the other person went back first to check on Duan. Then, Quentyn went to Duan's residence and put "the handgun in a dresser drawer" before getting back in the SUV to pick up the other person, court records said. Quentyn was pulled over by TCSO when he was driving to pick up his mother. According to the affidavit, he did not call 911 to report the shooting.
Quentyn remained in the Travis County jail Thursday, according to court records.
