PC Ben Monk, 42, was on Wednesday convicted of manslaughter after tasering ex-Aston Villa star Dalian, 48, six times longer than usual and kicking him in the head.
The Birmingham crown court jury was yesterday discharged after failing to reach a verdict on PC Mary Bettley-Smith, 31, who denied assault.
Prosecutors have a week to apply for a retrial.
