Florida AG Demands House Impeach Judge Who Freed Convicted Pedophile, Allowing Him to Murder 5-Year-Old Stepdaughter Missy Mogle Just Weeks Later

Florida Attorney General James Uthmeier is blasting the Florida House of Representatives for failing to impeach Leon Circuit Judge Tiffany Baker-Carper, more than a year after the judge released a convicted child sex offender on bond.

Judge Baker’s decision allowed the man to murder his 5-year-old stepdaughter just weeks later.

In a pointed post on X Tuesday, AG Uthmeier wrote:

“It’s been 385 days since Tallahassee Judge Tiffany Baker let a convicted sex offender walk out of the courtroom instead of into a prison cell, and he subsequently murdered 5-year-old Missy Mogle. The Florida House still hasn’t impeached Judge Baker. There’s no excuse.”

The pedophile, Daniel Spencer, was convicted in April 2025 of traveling to meet a minor for sex following an undercover sting operation.

Despite the State Attorney’s Office recommending he be held without bond pending sentencing, Judge Baker-Carper allowed Spencer to remain free, citing his lack of violent criminal history and prior compliance while on bond.

Weeks later, on May 19, 2025, Spencer and his wife, Chloe Spencer, allegedly beat and murdered 5-year-old Melissa “Missy” Mogle in their Tallahassee home.

According to court records and a grand jury indictment, Missy died from asphyxiation after being smothered and brutally beaten, with evidence showing her hands had been bound during the abuse. Disturbing surveillance video from inside the home allegedly captured hours of the abuse occurring in her own bedroom.

Fox 10 reported:

Responding officers noted “suspicious bruising and injury patterns” to Missy’s body, which indicated abuse.

She was taken to the hospital, where she was pronounced dead. An autopsy also determined that the 5-year-old was malnourished.

Investigators found images on security cameras in the girl’s bedroom that allegedly showed Daniel Spencer “physically abusing [the girl] by hitting her, violently pulling her arms, shoving her face into a bed, binding her feet and hands together, and covering her with pillows and comforters.” Additionally, her blood was found on her pillows and comforter.

Other photos recovered showed Chloe Spencer “standing over [her daughter], who was on her bed in the fetal position, while Chloe held an object over her head as if she was preparing to hit [her] with the object.”

The 23-year-old mother later told authorities that she hit the girl with the shoe, court records say.

The couple claimed Missy had “behavioral issues” and would hold her breath during tantrums, but investigators determined the injuries were the result of prolonged, violent abuse.

Both face first-degree murder charges and could receive the death penalty if convicted.

The avoidable tragedy directly led to the passage of “Missy’s Law,” which bars judges from releasing certain convicted sex offenders and violent criminals on bond between conviction and sentencing.

Governor Ron DeSantis signed the bill into law on March 31 and used the occasion to publicly call for Baker-Carper’s impeachment.

AG Uthmeier sent a formal letter to House Speaker Daniel Perez the same day, urging immediate impeachment proceedings, stating the judge’s actions “brought disrepute upon the judiciary” and directly contributed to the child’s death.

The letter read, in part:

Floridians expect judges to apply the law as written and to use their discretion properly and in the interest of justice to keep Floridians and their families safe from predators like Spencer. Government exists to protect the lives, liberty, and property of the people, and the first duty of all public officials is to ensure public safety. Judge Baker-Carper failed in her most fundamental duty and should no longer be a judge in this State. I ask that the Florida House of Representatives begin impeachment proceedings against Judge Baker-Carper immediately. My office is ready to assist you and the Florida House of Representatives to ensure that Judge Baker-Carper never hears another case again.

Despite repeated calls from the governor and the state’s top law enforcement officer, the Florida House has taken no action on impeachment.

Judge Baker-Carper later recused herself from presiding over the Spencers’ murder trials following defense motions citing the intense public and political scrutiny.

As of this writing, the Florida House has issued no public response to the latest demand from the Attorney General.
