Why are Kellogg’s Pop Tarts being sued?

A New York woman, Elizabeth Russett, has filed a class-action lawsuit against Kellogg’s, accusing the company of misleading consumers about the content of their breakfast pastries, Pop Tarts.

The $5million lawsuit alleges that there isn’t enough strawberry in strawberry Pop Tarts.

According to Russett, the fruit filling in strawberry Pop Tarts is mostly comprised of other fruits, like pears and apples.

The lawsuit claims the fruits within the filling of strawberry Pop Tarts don’t have the same nutritional value provided by strawberries.

According to the label on the back of the box, strawberry Pop Tarts reportedly are made up of two percent or less of apples, pears, and strawberries.

Russett reportedly wants Kellogg’s to be more accurate with their labeling, claiming the damages exceed the $5million she’s suing for.

When did Kellogg’s create Pop Tarts?

Pop Tarts were launched in 1963, with strawberry being one of the original flavors.

The name stems from the popularity of pop art in the 1960s, and is a nod to the art movement started by Andy Warhol.

The other original flavors included apple-currant, which is now apple-berry, blueberry, and brown sugar cinnamon.

Originally, Pop Tarts came out of the package unfrosted, as Kellogg’s didn’t yet have a frosting that wouldn’t melt off in the toaster.

In 1967, that changed and Pop Tarts became a frosted treat, meant to be found in the baking aisle.

As of 2021, there are currently 33 flavors of Pop Tarts available.

These flavors include Red Velvet Cupcake, S’mores, and Hot Fudge Sundae.

Is there a Pop Tarts movie?

In June of 2021, comedian and actor Jerry Seinfeld revealed he would be making a movie about the origin of Pop Tarts.

The movie, Unfrosted, will show Jerry Seinfeld as director, producer, co-writer, and star.

Netflix won the rights to the movie in an auction over the spring. Production is set to start sometime in early 2022.

According to Jerry, the Pop Tarts movie is based on a running bit he’s had going for about ten years now.

“Stuck at home watching endless sad faces on TV, I thought this would be a good time to make something based on pure silliness,” Seinfeld said. “So we took my Pop Tart stand-up bit from my last Netflix special and exploded it into a giant, crazy comedy movie.”
