DA charges teen with shooting into gang rival’s car
The Alameda County District Attorney’s Office charged an 18-year-old with multiple firearms-related felonies in connection with a shooting of an occupied vehicle late last month, authorities said Thursday.
The teen, identified as Colby Demarea Berry, was detained and arrested shortly before 1 p.m. Tuesday in Fremont, according to a county records check. In a statement, police said officers found Berry, who they said was a gang member, had a semi-automatic handgun with a high-capacity drum magazine.
According to police, Berry went to a barbershop in the 200 block of MacArthur Boulevard on Sept. 30 and recognized a rival gang member in the shop. Berry then left the shop and laid in wait for the rival to leave.
When the gang member and another person left and got into a vehicle, Berry pulled out a gun and fired four times at it before fleeing. Police said no one was hit.
Investigators assigned to the incident soon gathered evidence pointing to Berry as a suspect, leading to his arrest this week, police said.
“This arrest was made possible thanks to the dedicated, diligent, and focused work by detectives,” San Leandro police Lt. Ted Henderson said. “We also would like to send a ‘thank you’ to the Fremont Police Department who assisted us by apprehending Barry.”
The district attorney’s office charged Berry with assault with a semiautomatic firearm, shooting at an occupied motor vehicle, carrying a concealed firearm on the person, and carrying a loaded firearm on one’s person in a city, according to county judicial records.
Berry was set for arraignment Thursday afternoon at Dublin’s East County Hall of Justice.
He was scheduled to be arraigned today and is being held without bail.
