Appeals court rejects German property usurper’s bid to lift detention
A German real estate agent accused of usurping Greek Cypriot properties in the north will remain in custody after the appeals court ruled on Monday to dismiss her challenge against a detention order.
In a unanimous decision, the court ruled that no violations had been identified which would justify overturning the original ruling, confirming that the court of first instance’s decision to continue detention remains in force.
During proceedings, defence lawyer Sotiris Argyrou argued for his client’s release, citing conditions at the central prisons and difficulties in preparing a defence.
He said she was unable to secure sufficient time and resources to review the case material and raised concerns about the overall length of detention pending trial.
Argyrou also proposed bail of up to €300,000and assured the court that his client would comply with reporting requirements.
Prosecution lawyer Anna Mattheou rejected the arguments, emphasising that the case is progressing steadily, with hearings taking place three times a week and the court already cross examining the 17th prosecution witness.
She argued that the expected duration of the trial is a key factor in assessing continued detention.
Addressing claims regarding prison conditions, she said that the coexistence of pre-trial detainees and convicted prisoners does not in itself constitute a violation of rights, adding that the defendant had consented to specific arrangements within the facility.
