Nicholas is suing contracting company Britton Excavating and Construction Services, led by Stephen Britton and Jessica Britton, for over $120,000, claiming unfinished work on his Ohio residence, alleging he paid $79,441 to renovate the home for medical needs, but only a $7,622 fence installation was completed before the contractor abruptly ended the agreement.
The complaint was filed on March 12 and obtained by People.
It includes a records of a petition for a full Civil Stalking Protection Order filed by the contractor last year, which a judge denied.
In December 2025, Stephen claimed to stop working with the actor on the renovations because he “became worried for his safety and his workers’ safety.”
At a hearing, he expressed they were “afraid to work at Nicholas’ house,” noting that there were allegedly “axes laying out, weapons.”
He also alleged that Nicholas put an AirTag on him and threw objects at workers.
“I’ve never had this happen to me before, and it was alerted for probably three days prior that my iPhone picked it up…then my wife, I sent something to her, and she discovered what it was and helped me figure it out. We did a little alert button on it and found it, et cetera, et cetera. So, we found this air device,” the contractor claimed.
“There were no breaches of contract at — at that time, period. I have substantial records showing, from employees that work there, that they were afraid to work — because that’s what this is about,” he also said, per the court documents.
“They were afraid to work at Nicholas‘ house,” he said of his workers.
“Throwing objects, swearing,” and he said Nicholas‘ behavior had nothing “to do with medicine, necessarily. That’s what they’re going to blame it on, that — his prescription medicines.”
The actor denied the worker mistreatment per the court records, saying “I don’t threaten people.”
“He’s a very calm, relaxed, individual with lots of physical problems and is not threatening in any way shape or form,” his attorney said in court, according to the documents.
Nicholas suffers from Cauda equina syndrome, which is a condition caused by severe compression of nerve roots at the base of the spinal cord.
He was arrested back in 2021 for prescription fraud, to which he pleaded guilty. He was sentenced to one year of probation. He was arrested multiple times between 2010 and 2021 and faced various charges, including resisting arrest, battery, domestic violence and public intoxication.
Nicholas appeared on Dr. Phil in 2015 to address legal issues amid a string of arrests and altercations with police, detailing his mental health struggles and alcoholism issues. He more recently starred in Dark/Web and Faking It.
