Kentucky Democrat Wants a Right to Kill Babies in Abortions

A Democrat in Kentucky has introduced a bill that would enshrine a constitutional right to abortion, a move pro-life advocates warn would strip away protections for unborn children and open the door to unlimited abortions.

House Bill 476, filed by Rep. Daniel Grossberg, D-Louisville, proposes a constitutional amendment establishing the right of Kentuckians to kill babies in abortions essentially in an unlimited way up to birth. It would allow some limits on late-term abortions but those limits are called a sham that just opens the door to abortion on demand.

Richard Nelson, executive director of the Commonwealth Policy Center, called the viability standard a hollow gesture, allowing for abortion at any stage based on the subjective claim of preserving mental health.

“HB 476 proposes to rewrite Kentucky’s Constitution by creating an unlimited right to abortion under the guise of ‘reproductive freedom’ but authentic freedom doesn’t marginalize members of the human community and pave the way for their demise,” Nelson said in an email. “Section 1 of Kentucky’s Constitution preserves the fundamental right of life. If this proposal makes its way into our constitution it would negate the first and most basic of our rights.”

House Bill 476 has been assigned to the Elections, Constitutional Amendments & Intergovernmental Affairs committee.

Addia Wuchner, executive director of Kentucky Right to Life, said HB 476 would strip away protections for unborn children and limit the ability of elected representatives to enact life-affirming safeguards for Kentuckians.

“HB 476 introduces constitutional ambiguity that invites litigation and judicial activism, placing ideology over human dignity,” Wuchner said. “Our Constitution should affirm the value of every human life, not be used to legalize abortion under the guise of reproductive health while erasing protections for the unborn.”

The proposal comes amid ongoing pro-life efforts in Kentucky to combat the illegal distribution of abortion-inducing drugs.

Kentucky Right to Life has highlighted entities such as Aid Access, ABUZZ, Safe Choice and AbortionFinder that actively market abortion-inducing drugs to Kentucky girls and women through digital platforms, including social media channels like Snapchat and other online media. These campaigns are designed to bypass state laws protecting babies and safeguards for women.

House Bill 646, Kentucky Right to Life’s priority legislation for 2026, aims to strengthen current law by increasing felony penalties under a clarified classification of trafficking in pharmaceuticals intended to terminate life. The bill directly addresses the illegal supply chain of abortion-inducing drugs entering the Commonwealth.

“The Texas case demonstrates that states must act when international and out-of-state entities attempt to override duly enacted protections,” Kentucky Right to Life said. “HB 646 is necessary to uphold the rule of law, protect women from unregulated pharmaceutical trafficking, and ensure that those who intentionally violate Kentucky statutes face meaningful consequences.”
