Trump Reverses Biden Policy Funding Abortion Travel for Illegal Immigrants
President Donald Trump is taking steps to reverse a policy from the Biden administration that used taxpayer dollars to pay for abortion travel for illegal immigrants.
Trump’s move would ensure that Americans’ are not on the hook for funding travel that enables the killing of unborn children.
The Department of Health and Human Services is advancing a new rule to end the use of taxpayer dollars for transporting unaccompanied illegal immigrant children to obtain abortions, rolling back a controversial Biden-era policy that facilitated ending the lives of babies before birth by helping them travel across state lines for abortions in states where it’s legal.
The move, announced on the morning of the 53rd annual March for Life, aligns federal policy with the longstanding Hyde Amendment, which prohibits taxpayer funding for most abortions.

HHS Secretary Robert F. Kennedy Jr. is overseeing the changes to the “Unaccompanied Children Program Foundational Rule,” originally proposed by the Biden administration in November 2022, and finalized in April 2024. That rule required the Office of Refugee Resettlement to ensure minors in federal custody had access to abortion, including transportation and ancillary services, even in states with abortion restrictions.
A senior ORR official emphasized the pro-life intent behind the reversal, stating, “This measure closes the funding loopholes that were introduced under the Biden administration. We’re not going to use any taxpayer dollars directly or indirectly for abortion services, except where it’s expressly authorized by law.”
The official added, “Our goal is to save lives both for these young children that are coming across the border, that are pregnant, and to save the lives of their unborn babies.”
President Donald Trump signed an executive order last January to enforce such protections across federal agencies, and the ORR has submitted the proposed changes to the Office of Management and Budget’s Regulatory Information Service Center. The official noted that HHS is committed to making the rule durable beyond the current administration, saying, “The president has committed to protecting unborn children, and the agencies have followed through with implementing the president’s executive order.”
The statement continued, “We are going to continue to protect life, and that’s exactly what we are doing, and we’re happy that this is coming out before the March for Life. We’re happy that we are protecting these unborn children and allowing them to come into the world.”
The reversal builds on earlier efforts by the Trump administration.
In July 2025, the Office of Legal Counsel issued a memorandum withdrawing a 2022 Biden-era opinion that had allowed federal funds for abortion-related transportation.
The memo stated, “This Office concluded in 2022 that the Hyde Amendment does not bar the Department of Health and Human Services from expending covered funds to provide transportation for women seeking abortions… Having been asked to reconsider, we now conclude that the Hyde Amendment prohibits the use of federal funds to provide ancillary services necessary to receive an abortion.”
Congressional Republicans have supported the administration’s actions with legislation to permanently codify the ban.
Rep. Mark Harris, R-N.C., who is leading the effort alongside Rep. Mary Miller, R-Ill., told The Daily Signal, “No American should ever have their tax dollars used to shuttle illegal aliens across state lines for abortions. That’s why we’re fighting to stop these outrageous Biden-era policies that turned federal programs into a taxpayer-funded Uber for abortions. We’re going to end it.”
Miller echoed the sentiment, saying, “Joe Biden turned federal agencies into abortion traffickers by directing the Office of Refugee Resettlement to arrange and finance abortion travel for illegal alien minors. President Trump’s administration is rightfully moving to reverse this shocking abuse of taxpayer dollars, and I’m proud to partner with Congressman Mark Harris on legislation that permanently ends it.”
