Pro-Life Woman Arrested for Instagram Post That Planned Parenthood Claimed Was “Intimidation”
Anastasia Rogers, an organizer with the group Survivors of the Abortion Holocaust, was arrested on Thursday, December 18th outside of Planned Parenthood at 1522 Bush Street in San Francisco.
Approximately two months prior, Rogers had been notified via phone call of a warrant for her arrest related to an Instagram reel made on the public sidewalk in front of the San Francisco Planned Parenthood. This video allegedly violated the vague and over-broad California FACE Act, which states the following:
“California Penal Code 423.2(g) Within 100 feet of the entrance to, or within, a reproductive health services facility, intentionally videotapes, films, photographs, or records by electronic means, a reproductive health services patient, provider, or assistant without that person’s consent with specific intent to intimidate the person from becoming or remaining a reproductive health services patient, provider, or assistant, and thereby causes the person to be intimidated.” (italics ours)

The video in question was a 14-second “handshake” trend reel to the song “Illegal” by PinkPantheress.
The first clip shows Rogers handshaking the air towards the camera, then cuts to show her handshaking the air in front of the clinic escort (a Planned Parenthood volunteer). The goal of the video was to highlight the polar opposite approaches the two people have to helping women in crisis pregnancies. The reel amassed nearly 400k views on Instagram. The escort being filmed did not tell Rogers not to film her nor seemed at all “intimidated” by her.
Survivors’ lawyer was unable to get any details related to Rogers’ warrant. After exhausting every option, Rogers and her lawyer reasoned that the lack of response to their repeated inquiries indicated that the “warrant” was either non-existent or designed to keep her from conducting outreach at Planned Parenthood. Rogers showed up to Planned Parenthood at 8:45am on Thursday with Robert Byrd from Pro-Life SF to pass out literature.
Rogers stated: “Thursday is a surgical abortion day and the last chance to get life-affirming resources into the hands of women going in to make the worst decision of their life.”
The security guard took Rogers’ photo while she waved to him. About an hour later an officer from the sheriff’s department arrived, apparently having been called by the security guard.
Rogers was arrested and taken into custody. As she was being handcuffed and led to the squad car, Byrd recorded her speaking to the camera and the footage was posted to social media in a now-viral video. Rogers spent about 7 hours in jail as was released. A court date is set for February. When asked about the impact of her arrest, she said,
Rogers spent about 7 hours in jail as was released. A court date is set for February. When asked about the impact of her arrest, she said,
“If Planned Parenthood thinks that throwing me in jail for 7 hours or 7 days is going to stop me from loving my neighbor – the preborn child, they’re wrong.”
Rogers has a court appearance set for Monday December 22 at 9 AM.
