Diddy Files Appeal, Demands Overturn of Conviction & Release From Prison
Sean “Diddy” Combs is trying to get out of prison.
The music mogul’s legal team filed an appeal Tuesday (December 23) demanding for his conviction to be overturned and for him to be released from prison.
He was found guilty on two counts of violating the Mann Act, or transporting individuals for purpose of prostitution.

The appeal accuses Judge Arun Subramanian of acting more like a juror than a judge, per TMZ.
His lawyers have filed appeals previously, but this one calls out the judge for acting like the “13th juror” in the trial. At the very least, they ask for his sentence to be reduced.
Lawyer Alexandra Shapiro called the 50-month sentencing “draconian” and based on the charges for which he was acquitted: racketeering and sex trafficking.
The lawyer also states that during sentencing, the judge incorrectly said that he could consider Diddy‘s behavior related to the violent charges, but he was acquitted of those.
“The judge defied the jury’s verdict and found Combs ‘coerced,’ ‘exploited,’ and ‘forced’ his girlfriends to have sex and led a criminal conspiracy. These judicial findings trumped the verdict and led to the highest sentence ever imposed for any remotely similar defendant — even though most others, unlike Combs, ran prostitution businesses that exploited poor or undocumented women or minors,” the filing states, via Page Six.
They are calling it a violation of Diddy‘s constitutional rights, asking for “immediate release and either grant a judgment of acquittal or vacate and remand for resentencing.”
Federal prosecutors still have time to respond before the case can possibly go to the appellate court.
