Masterson is making several claims in his motion filed in a California appeals court.
The actor claims that Cohen failed to call important witnesses during the trial or use evidence that would have aided his defense. The petition alleges that the lawyer only spoke to two out of 20 possible witnesses.
Masterson‘s new attorney, Eric Multhaup, said in a statement, “The unfairness of the second Masterson trial was the result of prosecutorial misconduct, judicial bias, and the failure of defense counsel to present exculpatory evidence. The habeas corpus petition is accompanied by 65 exhibits that document the evidence of innocence that could have been presented, but was not. The jury heard only half the story — the prosecution’s side. Danny deserves a new trial where the jury can hear his side as well.”
Masterson also believes that his previous lawyer failed to push back against the prosecution focusing on his involvement in the Church of Scientology, claiming that there was bias in the trial.
The news comes just weeks after Danny‘s ex-wife filed to have his last name removed from their daughter’s legal name.
