Why paying with credit could cost you more in Kansas
WICHITA, Kan. (KSNW) -- As of Jan. 1, a new law in Kansas allows businesses to charge credit card customers an extra fee. Some customers have already noticed the surcharge on their receipts.
However, the Sedgwick County District Attorney's Consumer Protection Division wants businesses to know that guidelines must be followed to add the surcharge.
The business has to post a "clear and conspicuous notice to the customer at the point of entry or the point of sale and in advance of such transaction."
KSN has heard of surcharges at restaurants, dentist offices, and heating and cooling companies.
According to federal law, the surcharge cannot exceed four percent.
Kansas used to ban credit card surcharges, but in 2021, a federal court said the ban was unconstitutional.
If you want to pay with a debit card, you should be safe from a surcharge. The DA's office says debit card surcharges are illegal in all 50 states under federal law.
