'Sabotage': Texas A.G. Ken Paxton takes legal action to stop border wall part auctions
Texas Attorney General Ken Paxton late Tuesday asked a federal judge to determine whether the Biden administration is violating a permanent injunction by selling off unused border wall parts.
Paxton, a staunch Trump ally, is the latest in MAGA world to call out President Joe Biden after reports surfaced that the administration sold off unused parts of the U.S.-Mexico border. But the Texas attorney general appeared to be the first to take his complaints to court with the filing of a motion seeking to enforce a permanent injunction.
“The Biden Administration cannot auction off sections of the border wall,” Paxton said in a statement Tuesday. “If these reports are true, the Biden Administration is violating a federal court order.”
Paxton wants U.S. District Judge Drew Tipton to first order a status conference at the court’s “earliest convenience” to determine whether the administration’s border wall auction is in disregard of its final judgment and permanent injunction.

"As a first step, a status conference is necessary so that defendants can explain to the court and plaintiffs why taxpayer monies, and the congressional appropriation adjudicated by the court for specific purposes, are apparently being squandered for purposes unauthorized by Congress and in violation of the Court’s permanent injunction," Paxton wrote in the legal motion filed Tuesday in the Southern District of Texas.
Paxton secured a final victory in May that required the federal government to continue construction of the border wall with funds already allocated for that purpose.
“Texas is going to court to prevent any border security materials from being unlawfully sold and to find out the truth about what the federal government may be doing to subvert border wall construction,” Paxton added. “President Trump has an overwhelming mandate from the American people to build the wall and I will do everything in my power to prevent any acts of sabotage by the outgoing administration.”
